Thai Constitutional Courts Accept Petition against PM Paetongtarn and Orders Temporary Suspension from Duties

On July 1, 2025, the Constitutional Court of Thailand convened to consider a petition submitted by Mongkol Surrasatja, President of the Senate of Thailand, acting on behalf of 36 senators.

The petition requested the Court’s interpretation of whether the premiership of Paetongtarn Shinawatra should be terminated under Section 170, Paragraph 3, and Section 82 of the Constitution.

The case stems from the leaked audio clip of a conversation between the PM and Hun Sen, President of the Senate and former Prime Minister of Cambodia.

The contents of the conversation allegedly referenced Thailand’s 2nd Army Commander and indicated conduct considered traitorous, involving accusations of betraying the nation—allegedly undermining Thai sovereignty, the military, and the public.

The petitioners also requested that the Constitutional Court suspend Paetongtarn from her duties as Prime Minister until a final ruling is issued.

On Tuesday, the Constitutional Court resolved unanimously (9-0) to accept the petition for consideration. By a 7-2 majority, the Court ordered Paetongtarn to cease her Prime Ministerial duties until a ruling is made.

Notably, despite the suspension from her Prime Ministerial role Paetongtarn may continue her duties as Minister of Culture.
