Appeals Court Puts Brake on Trade Court’s Tariff Decision as Trump Pushes Back

A federal appeals court on Thursday agreed to the Trump administration’s request to temporarily halt a lower court decision that invalidated most of President Donald Trump’s tariffs.

The U.S. Court of Appeals for the Federal Circuit issued an order staying the decision made late Wednesday by the U.S. Court of International Trade. The stay will remain in effect while the appellate court reviews filings related to the case.

Officials from the Trump administration had previously informed the appellate court that they would seek emergency relief from the Supreme Court as early as Friday if the injunction was not put in place swiftly. The appeals court’s decision now provides the administration with a critical window to prepare its legal defense, seeking a continued suspension of the lower court’s ruling throughout the ongoing appeals process.

Meanwhile, Trump officials insist they retain alternative tools for enacting tariffs should the legal challenge ultimately not go their way.
